On 3 December 2009, the 'Internal Revenue Service has illegally auctioned 7,100 acres of tribal land situated in the reserve Crow Creek Sioux. The land is owned by the Crow Creek Tribal Farms, Inc., a tribal society with separate legal personality from the Crow Creek Sioux Tribe. According to the lawsuit, the IRS has auctioned the land to recover mudah more than $ 3.1 million in federal taxes owed by the tribe to work. Because of incorrect tax advice received by the Bureau mudah of Indian Affairs, the Crow Creek Sioux Tribe has become girlfriend in the payment of employment taxes collected by the beginning of 2003. The tribe then filed a lawsuit in the District Court of Pierre looking to block the sale. Judge Robert A. Lange rejected their request, but promised to schedule a trial to hear the arguments mudah of the tribe. The tribe also argues that the seizure is illegal because the land can not be taken without the approval of Congress and the IRS has not followed a federal law that requires an environmental impact mudah assessment for the sale. The reserve Crow Creek was created by the Treaty of 1868, Act of April 29, 1868, 15 Stat. 635, and in section 6 of the Law of March 2, 1889, 25 Stat. 888. It has a population of 1,230 members, divided into two main bands, mudah and Mdewakanton Ihanktonwan. The reserve Crow Creek Sioux includes the counties of Buffalo, Hyde, and Hughes and is consistently documented as one of the reserves of the nation's poorest, with 78% of their members who are living below the poverty line. This action by the IRS is despicable and irreparable damage, ultimately, could eliminate 20% of the land in the reserve of the Crow Creek Sioux Tribe. The Tribal Chairman Brandon Sazue said he hopes the tax dispute can still be resolved in a way that allows the tribe to keep the land. "It 'a shame, very shameful. As to the BIA, spread a pitiful veil .. On what then the Crow Creek Tribe must pay taxes is unclear, given that the land belongs to a cooperative tribal yet to tribù..che should be tax-free or not?
